9. Non-Hexagon Services. Hexagon may offer certain services, features or functionality as part of services provided by unaffiliated third parties (“Non-Hexagon Services”). Access to these services other than Hexagon may cause your computer to communicate with a third-party website. Such connectivity or access to third-party websites or third-party materials is subject to the terms of such websites, and access to and use of non-Hexagon services may require you to agree to separate terms. By linking to or using Services other than those of Hexagon, you agree to be bound by these Terms. Hexagon Group companies are not parties to such agreements with third parties and are not responsible for such Services other than Hexagon. Hexagon may change or discontinue the availability of non-Hexagon Services at any time and for any reason. Anyone who requires access must agree to the terms of use set forth in OT`s ProjectWise Network External User Access Terms as a condition of access to the ProjectWise network.
In particular, the principles of academic freedom, freedom of expression and secrecy of information have important implications for the administration of computer systems at UCB. Individuals with privileged access must comply with applicable policies, laws, regulations, precedents and procedures, while taking appropriate steps necessary to provide high-quality, timely and reliable IT services. For example, individuals must comply with the University of California`s (UC) Electronic Communications Policy (ECP), which requires the least content review and the least action required to resolve a situation. Authorization In most cases, the consent of the owner of an electronic communication protocol (see definitions in Appendix A of the ECP) must be obtained before accessing its files or interfering with its processes. If consent cannot be obtained, the BCP conditions for “access without consent” must be met. (See Section IV of the ECP. B and also “Authorization of access to electronic communications on the Berkeley campus.”) 12. Acceptable Use. You must ensure that all of your authorized end users comply with the Acceptable Use Policy (“AUP”). The latest version of the PUA published hxgncontent.com/global/acceptable-use-policy is included here by reference. An authorized end user may be asked to review and accept the AUP to access the Services. Hexagon reserves the right to change the AUP at any time.
Any update to the AUP may result in the re-acceptance of the modified AUP by each authorized end user. Failure to comply with the AUP may result in the suspension of the Services or termination of this Agreement for material violations. During any suspension period, you will continue to be responsible for paying the applicable fees. If my employment at the university ends or if my professional responsibilities no longer require access to the data or the scope of the required access changes, I have the joint responsibility with the data holder to ensure that my access to the system is revoked or modified accordingly. If my access is not changed in time, I will inform the data controller. 6. Fees and Taxes. The Data Store defines the fees, subscription duration and other terms related to access and use of geodata and is incorporated into and forms part of this Agreement. Fees exclude all applicable sales, use, value-added, GST and other taxes (and all applicable tariffs, duties and similar fees), and you are responsible for paying all such taxes (excluding taxes based on Hexagon`s net income), duties, duties and fees (and any associated penalties and interest) incurred under this Agreement or the provision of services under this Agreement. of this Agreement. Agreements must be paid. The total invoice amount for the fees may be increased by the amount of taxes that Hexagon is required to pay and/or that you are required to withhold, collect or pay the fees in order for Hexagon to receive the full amount of the fees charged.
If you are applying for tax exemption status, you must provide a copy of a valid tax exemption certificate. The purpose of the data access agreement is to establish the conditions under which users will have access to the data provided and to obtain the express acceptance of these conditions by a user before granting him access to the data. 7. Restrictions. The Geodata and Services may only be used by the Authorized End User or by individual users authorized by Hexagon in writing and not by any other party. No part of the Geodata, services or products derived therefrom or any rights granted under this Agreement may be copied (except internally in the case of pixel downloads as described above), sold, rented, rented, loaned, sublicensed, disclosed or transferred to any other person or entity. Authorized End User may not use any part of the Geodata or services to develop or derive any other product or service for distribution, disclosure or commercial sale, whether in print, digital or web, without a license expressly authorizing the Authorized End User to do so, provided that no such rights are granted under this Agreement. You have no other rights in the Geodata except as expressly set forth in this Agreement.
Without limiting the foregoing, you may not resell, redistribute, or access geodata as a web service. You may not use the geodata as part of a service desk or for timeshare purposes or allow third parties to use the geodata, except for authorized end users expressly authorized by this Agreement. You may not disclose passwords or other credentials to third parties, except authorized end users. You and any Authorized End User acknowledge that the Geodata and Services contain and embody proprietary materials, valuable data, trade secrets and copyrights of Hexagon and its licensors and suppliers. Unauthorized reproduction, modification, distribution or display of the Geodata or Services, in whole or in part, and in a manner not expressly permitted in this Agreement, is prohibited. You must keep Authorized End Users confidential and do your best to protect the Geodata and Services and prevent their unauthorized disclosure or use. Authorized End User must immediately notify Hexagon if it discovers evidence of current or threatened misuse or unauthorized use or disclosure of geodata or Services by any party. You may not modify, distort, disassemble, decompile or otherwise attempt to reverse engineer the Services or software provided as part of the Geodata or the Geodata themselves, and you may not cause your Authorized End User to modify, distort, disassemble, decompile or otherwise attempt to reverse engineer them. Each authorized end user must comply with the Acceptable Use Policy. 13.
Term. Hexagon may terminate this End User Access Agreement, which terminates all access to the Services and Geodata if the Authorized End User fails to comply with any provision of this Agreement. Upon termination, authorized End User must immediately return or destroy the Geodata to Hexagon and confirm such destruction in writing to Hexagon. 2. Geodata Rights. Your rights to use geodata vary depending on whether you purchased a streaming subscription or a pixel download from the data store. In this Agreement, “you” and “your” refer to the legal entity or natural person for personal use who has created an account in the data store to acquire access to geodata. Designation of data sensitivity.
The data [record name] in [system name] is classified as UC P1-P4 (formerly UCB PL0-PL3) and data protection has been defined accordingly. I agree to maintain the quality and integrity of the information I access and to protect the confidentiality of the personal information of an individual I access. (Example of a UC P2/P3 system (formerly UCB PL1) where users enter/edit records :)I recognize that UC Berkeley must have strict access control over personal information that includes a person`s name or initials in combination with: Individuals with privileged access must respect the rights of system users, respect the integrity of the systems and the physical resources associated with them, and comply with any relevant laws or regulations. .
